Board of Supervisors (BOS) Meeting November 16, 2009
1. Development Services - Text Amendment to the Zoning Ordinance Section 603. (Light Pollution Control) C.3.f. (Lighting Requirements, Residential), HA# H9039, Steven Mauk, Land Use Manager. On October 21, 2009 the Planning and Zoning Commission recommended approval of the Zoning Ordinance Amendment. On 11/16/09 the BOS unanimously approved; specifically grandfathering flag illuminations prior to 2001.
2. Development Services - Text Amendment to the Zoning Ordinance to amend Section 301 (Definitions) and the addition of a new Section: Section 565 (Park Models), HA# H9089, Steven Mauk, Land Use Manager. On October 21, 2009, the Planning and Zoning Commission recommended approval of the Zoning Ordinance Amendment. On 11/16/09 the BOS voted 2 -1 to approve, with Chip Davis opposed. Subsequent research revealed no appeal to the Superior Court was advisable. County legal staff advises: "There is no �appeal� of this decision. However, the BOS decision could theoretically be challenged on constitutional grounds (none exist here) or on the grounds that the BOS exceeded their authority, but this decision raises no constitutional issues and is well within their police powers."
Variance Request for APN 405-14-024H Rimrock Storage E Beaver Creek Road
Rimrock Super Storage wants a sign for their business. If they had chosen to place the sign further back on the property we would have no say in the matter. The requested setback variance is to "save a fruit tree". I spoke with the owner Joseph Tardie and advised him there was opposition and invited him or an agent to attend the December 4th, 2009 BCRC meeting.
